Toute utilisation ou exploitation faite en violation des conditions particulières est constitutive d'une atteinte aux droits du titulaire, réprimée en application des conventions internationales et de la législation en vigueur dans chaque pays.
La clause compromissoire:
Tout différend découlant des conditions particulières, qui formalisent des relations contractuelles entre un utilisateur et un titulaire de droits sur une création identifiée ou s'y rapportant, sera soumis à un arbitrage pour règlement définitif.
La procédure se déroulera conformément au Règlement d'arbitrage accéléré de l'OMPI.
A défaut d'accord particulier, le lieu de l'arbitrage sera Montpellier (FRANCE) et la langue de la procédure d'arbitrage sera le français. Il sera statué sur le différend conformément au droit du pays au titre de la nationalité de l'œuvre. Les parties acceptent que l'ensemble de la procédure puisse être exécutée en ligne.

The copyright protects:
A digital image over which rights are claimed on the basis of authors' rights (Bern Convention and Universal Copyright Convention), neighbouring rights (Rome Convention), the TRIPS agreement or any contractual undertakings.
The special conditions for the use and exploitation of the image, as laid down by the author and rightholder, Grégoire Dupond.
These special conditions are:
Any use, copy or exploitation of the image is subject to authors' rights and approval.
The author reserves himself the freedom to refuse any approval on it's sole decision.
To contact the author in any circonstances regarding the use, copy or exploitation of any protected image is compulsory.

Enforcement of rights:
Any use or exploitation that is made in breach of the special conditions shall constitute an infringement of the rights of the holder, being prohibited under international conventions and the applicable domestic law in each country.
Arbitration clause:
Any dispute that may arise with respect to the special conditions, which govern the contractual relations between a user and the rightholder pertaining to a creation, or related thereto, shall be referred to arbitration for final settlement. The procedure shall be based on the WIPO Expedited Arbitration Rules
In the absence of any specific agreement the place of arbitration shall be Montpellier (FRANCE) and the language to be used in the proceedings shall be French. The dispute shall be settled in accordance with the domestic law of the country of the work's nationality. The parties hereby agree that the entire proceedings may be conducted on-line.
